Registering a lease agreement in Belgium is a legal obligation that falls on the landlord, to be completed within two months following signature. Who is obliged to register the lease?

This rule applies in all three regions of the country, although the practical procedures differ depending on the region where the rented property is located. Residential tenancy law is regionalised in Belgium: Wallonia, Brussels-Capital and Flanders each have their own legislative framework. What is the deadline for registering the lease?
For residential leases (primary residence), the deadline is two months from the date of signing the contract. This deadline is mandatory: non-compliance immediately triggers the penalties provided for by regional legislation.
For other types of leases (commercial, garages, land, parking), the deadline is four months and registration is subject to fees.
Practical example: a lease signed on 1 March must be registered no later than 1 May of the same year.
With which service should the lease be registered?
The answer depends on the region in which the property is located:
In Wallonia
The registration of residential leases in the Walloon Region remains federal and is done via the MyRent platform, accessible from the MyMinfin portal of the FPS Finance. Registration can be done:
- Online via MyRent on the FPS Finance website (the fastest solution)
- By postal mail by sending the signed copies to the FPS Finance scanning centre
The landlord must provide the scanned contract, the parties' contact details and the amount of the rent. A confirmation is sent by e-mail once the registration is validated.
In Brussels-Capital
The situation has been more complex since 1 January 2025. The Brussels Region has adopted an ordinance aimed at regionalising the registration of leases via the regional platform Irisrent. However, the FPS Finance maintains that federal registration via MyRent also remains mandatory pending the final decision of the Constitutional Court on this point.
In practice, Brussels real estate professionals recommend carrying out a double registration: with Irisrent (regional) and with MyRent (federal) to be covered in all cases.
In Flanders
In the Flemish Region, registration remains federal and is also carried out via MyRent of the FPS Finance. The civil consequences of non-registration are governed by Flemish legislation on primary residence leases. Flanders has not yet set up a separate regional platform for the registration of residential leases.
What is the cost of registration?
Registration is entirely free for primary residence leases, whether it is a flat, a house or a student room allocated exclusively to housing. No proportional duty is payable.
On the other hand, for non-residential leases (commercial, garage, parking, land), a registration duty of 0.2% of the total amount of rents and charges is due, with a minimum of €50. In the event of late registration, any additional costs are exclusively borne by the landlord.
What are the penalties for non-registration?
Failure to register within the legal deadline has several consequences, which vary by region:
In Wallonia and Brussels-Capital
The consequences for the landlord are significant:
- The tenant can terminate the lease without notice or compensation. This option becomes available as soon as the two-month deadline expires, as long as registration has not been completed. The tenant must first send a formal notice by registered letter, allowing the landlord a reasonable period to regularise. If the lease is still not registered, termination without financial consequences becomes possible.
- The landlord cannot index or revise the rent as long as the lease is not registered.
- A federal fine of €25 to €50 may be claimed from the landlord.
- In the event of the property being sold, the unregistered lease does not have a "certain date", which weakens the tenant's position vis-à-vis the new purchaser.
In Flanders
The Flemish Region provides for similar consequences: in the absence of registration within two months, the tenant can terminate the lease without respecting the usual notice period and without compensation, provided that they have previously sent a formal notice by registered letter to the landlord. The rent also cannot be indexed during the period of non-registration.
How can the tenant protect themselves?
The tenant has every interest in checking that their lease has been properly registered within two months following signature. Some practical reflexes:
- Request a copy of the proof of registration from the landlord upon receipt (MyRent or Irisrent confirmation).
- Keep all documents related to the lease: signed contract, proof of registration, rent receipts, correspondence.
- In case of doubt, contact the FPS Finance to check whether the lease appears in the MyRent register.
- If the lease is not registered after two months, send a formal notice by registered letter before asserting your rights.
