In Wallonia, residential leases are governed by the decree of 15 March 2018 on residential leases, integrated into the Walloon Housing and Sustainable Living Code (CWLHD). What are the types of primary residence leases in Wallonia?
The Walloon decree distinguishes three main types, each with its own rules.
1. The standard-term lease (9 years)
This is the reference term for primary residence leases in Wallonia. The 9-year lease offers the greatest stability for tenants: the landlord can only terminate it at a triennial anniversary (3rd, 6th or 9th year) or at the final expiry, with 6 months' notice. Tenants, however, can terminate the lease at any time with 3 months' notice.
If the landlord wishes to reclaim the property for personal occupation (or for a close relative) or to carry out major works, this can be done at a triennial anniversary but requires enhanced notice periods and, depending on the case, payment of compensation.
2. The short-term lease (maximum 3 years)
The short-term lease allows for a rental period of 3 years or less. It can be renewed twice at most, provided that the total duration, including renewals, does not exceed 3 years. Beyond that, the lease is automatically reclassified as a 9-year lease.
If the tenant terminates early, they must give 3 months' notice and pay one month's rent as compensation to the landlord. The landlord, on the other hand, can only terminate a short-term lease early under very strict conditions (personal occupation, works required by public authority).
Note: since the March 2024 lease reform in the Brussels Region, certain rules on short-term leases have changed in Brussels. These amendments do not apply in Wallonia, which remains governed by the 2018 Walloon decree.
3. The sliding primary residence lease
The sliding lease is a social mechanism provided for by the CWLHD. A government-approved property operator leases a dwelling from an owner and sub-lets it to a household in a precarious situation, who receive personalised social support. The sub-tenant enters into a contract for one year, renewable, not exceeding three years in total.
If the social support objectives are met, the lease "slides": the operator withdraws, and the main lease is transferred directly to the sub-tenant household, who become the direct tenant of the owner. The property thus becomes a permanent home after a transitional learning phase towards autonomy.
For the landlord, this mechanism offers a tax advantage in the form of exemption from property tax for the duration of the sliding lease.
What are the statutory notice periods by lease type in Wallonia?
Notice periods vary according to the type of lease and which party gives notice:
- 9-year lease, tenant: 3 months' notice, at any time, effective from the 1st day of the month following notification.
- 9-year lease, landlord: 6 months' notice to terminate the lease at expiry (end of 9 years or a triennial period).
- Short-term lease, tenant: 3 months' notice + one month's rent compensation in case of early termination before expiry.
- Short-term lease, landlord: highly restricted early termination; the landlord can only terminate before the end of the term in limited cases provided by the decree.
Notice must be served by registered post, by bailiff or hand-delivered with acknowledgement of receipt. It takes effect on the 1st day of the month following receipt.
What is the maximum rental deposit in Wallonia?
The 15 March 2018 Walloon decree strictly regulates the rental deposit. It is not legally mandatory, but appears in almost all leases. When required, its amount is capped:
- Individual blocked account: maximum 2 months' rent excluding charges.
- Bank guarantee or CPAS guarantee: maximum 3 months' rent excluding charges.
For a primary residence lease, the deposit must be placed in a blocked account in the tenant's name. Interest generated on this account belongs to the tenant. It cannot under any circumstances be used to pay current rent: it only covers shortcomings identified at the end of the lease (damage, unpaid charges, overdue rent).
Since 3 May 2021, a zero-interest loan has been available from the Walloon Social Credit Society to help tenants constitute this deposit, which concretely facilitates access to housing for low-income households.
How does rent indexation work in Wallonia?
Each year, on the lease anniversary date, the Walloon landlord may request an adjustment of the rent in line with the evolution of the cost of living. Indexation is based on the gross health index published monthly by Statbel.
The formula applied is:
Indexed rent = base rent × (new health index ÷ starting health index)
Several conditions are cumulative:
- The lease must be registered with the FPS Finance within 2 months of signing: without registration, the landlord loses the right to indexation.
- Indexation must be requested in writing from the tenant; it is not automatic.
- Retroactivity is limited to the previous 3 months: a landlord who forgets to request indexation can only recover the 3 months preceding their written request.
In 2026, a new health index base (2025 = 100) came into effect, and the restrictions linked to the EPC certificate (applicable between November 2022 and October 2023) are no longer in force: the rule has become uniform for all Walloon properties.
What are the obligations of the Walloon landlord?
The Walloon decree imposes several mandatory obligations on the landlord:
- Deliver a compliant dwelling: the property must meet minimum standards of health, safety and habitability set by the CWLHD. It must be structurally sound, watertight, ventilated and equipped with compliant electrical installations.
- Provide a written lease: a written lease is mandatory in Wallonia; an original copy must be given to each party.
- Register the lease: registration is free and must take place within 2 months of signing. This is the landlord's responsibility. An unregistered lease deprives the landlord of the right to indexation and allows the tenant to leave without notice or compensation.
- Warranty against defects: the landlord is bound by an obligation to guarantee against hidden defects and cannot modify the property without the tenant's consent.
- Carry out major repairs: structural works (roof, load-bearing walls, main heating installations) are the landlord's responsibility.
What are the obligations of the Walloon tenant?
In return, the tenant is subject to several obligations:
- Pay rent and charges on the date agreed in the contract.
- Take out fire insurance: in Wallonia, the tenant is obliged to take out insurance covering rental risks. If this obligation is not met, the landlord can charge the cost to the tenant.
- Use the property responsibly: routine maintenance, minor rental repairs, respect for neighbours.
- Return the property in good condition at the end of the lease, taking into account normal wear and tear.
- Not sub-let without agreement: any sub-letting requires the prior written consent of the landlord.
