Terms and Conditions of Use for Tenants

Version 2.0. Entry into force: 2 June 2026. These terms and conditions are addressed to tenants acting as consumers. As a consumer, you benefit from the mandatory protections of Book VI of the Belgian Code of Economic Law.

1. Who we are

The IMMOTECTO platform is published by IMMOTECTO SRL, BCE 1037.432.024, VAT BE1037.432.024, whose registered office is at Rue de Namur 13D, 1476 Houtain-Le-Val, Belgium (hereinafter, "we"). We provide a technical tool. We are neither an estate agency, nor a broker, nor a guarantor, nor a trusted third party, and we never select tenants on behalf of landlords.

2. Services available to you

  • Advertisements: viewing rental and sale advertisements published by professionals.
  • Tecto Score: an indicator of your rental payment reliability, which you generate voluntarily. It is based on the punctuality and regularity of your rental payments. It measures payment behaviour, not your income or its origin, and is not a credit score.
  • Tecto Annuaire: you can choose to make yourself visible to professionals. This visibility is voluntary and revocable at any time.
  • Tecto Dossier: a space where you host your personal documents. You remain the owner of your documents, you add and share them on your sole initiative, and you can delete them at any time, their deletion being effective.

The services offered to tenants are provided free of charge, without financial consideration.

The use of Tecto Score, Tecto Annuaire or Tecto Dossier is always voluntary and at your initiative. It is never a condition imposed by the Platform to apply for accommodation.

3. Open Banking (Tecto Score)

The Tecto Score is calculated from your payment history, via an Open Banking connection operated by our service provider Bridge, within the framework of the Payment Services Directive (PSD2). This connection is based on your explicit, free, specific, informed and unambiguous consent. The connection is read-only.

You may withdraw your consent at any time, without this having any consequence on your account. Only the derived score is retained: your raw banking data and your banking credentials are not retained by the Company.

4. Your Tecto Dossier

You remain the owner of the documents you deposit. You alone decide what you share, with whom, and for how long. You can withdraw a share or delete your documents at any time. The deletion of a document by you is effective: the document is deleted from the Platform.

The withdrawal of a share blocks all future access to your documents via the Platform. It does not apply to copies that a professional may have already made before the withdrawal, which fall under the responsibility of that professional as data controller.

5. Your consumer rights (Belgian law)

As the services are provided to you free of charge, you make no payment and no sum can be claimed from you in this respect. You also benefit from the protections of Book VI of the Code of Economic Law:

  • Right of withdrawal: for distance contracts, you have a 14-day cooling-off period, without giving reasons. In the case of free services, the exercise of this right entails neither payment nor refund.
  • Legal guarantee of conformity: the digital service must conform to what is advertised; failing this, you have the remedies provided for by law.
  • Mediation: in the event of a dispute, you can use the Consumer Mediation Service (Belgium) free of charge.

6. Automated decision-making

Under Article 22 of the GDPR, you have the right not to be subject to a decision based solely on automated processing. The Tecto Score is a decision support tool for professionals, not a decision. You have the right to human intervention, to express your point of view and to contest a decision concerning you.

7. Intellectual property

We grant you a strictly personal and non-transferable licence to use the Platform. For content that you upload, you grant us a limited licence for hosting and display, for the sole purpose of providing the service. This licence ends when you delete the documents concerned, their deletion being effective.

8. Absence of unfair terms

No clause herein may create a significant imbalance to your detriment. Any clause that would be deemed unfair within the meaning of Book VI of the Code of Economic Law shall be deemed unwritten.

9. Account closure

You can close your account at any time from your account area. Closure results in the deletion of your data and your Tecto Dossier, with the exception of what the law requires us to retain (in particular accounting documents). Shares already made to a professional are not recalled by account closure: they fall under the responsibility of the recipient professional.

10. Applicable law

These terms and conditions are governed by Belgian law. As a consumer, you retain the benefit of mandatory consumer protection provisions of your country of habitual residence when these are more favourable to you.
