Terms and Conditions of Use for Professionals

Version 2.0. Effective date: 2 June 2026. These terms and conditions apply to professional users (landlords and real estate agencies). Tenant consumers are subject to the Terms and Conditions for Tenants, a separate document.
1. Identification and purpose
The IMMOTECTO platform (hereinafter, the "Platform") is published by IMMOTECTO SRL, BCE 1037.432.024, VAT BE1037.432.024, with its registered office at Rue de Namur 13D, 1476 Houtain-Le-Val, Belgium (hereinafter, "we" or the "Company").
These terms and conditions govern the access to and use of the Platform by any professional acting within the scope of their business (landlord, property management company, real estate agency), hereinafter the "Professional".
2. Definitions
- Listing: offer to sell or rent real estate published by the Professional.
- Tecto Score: indicator of rental payment reliability of a prospective tenant, based on the timeliness and regularity of their rental payments, weighting recent payments and taking into account the level of source verification. The Tecto Score is not a measure of solvency, income or its origin, nor a credit score.
- Tecto Annuaire: directory in which a tenant voluntarily chooses to make themselves visible to Professionals.
- Tecto Dossier: document space in which the tenant hosts their personal documents and shares them on their own initiative only.
- Applicant: tenant who voluntarily shares all or part of their information with a Professional.
3. Nature of the service, what we are not
We provide a technical tool for hosting listings and facilitating connections. We do not act in any capacity as a real estate agency, broker, trusted third party, guarantor or agent of any party.
We do not validate, select or verify applicant files on behalf of the Professional. The Professional remains solely responsible for examining applications, selecting the tenant and complying with their legal obligations.
4. Services accessible to the Professional
- Publication and management of sales and rental listings.
- Consultation of Tecto Score, Tecto Annuaire and elements of Tecto Dossier that the tenant chooses to share.
- Messaging with applicants who have initiated sharing.
The Platform does not provide any functionality other than those described in this article.
5. Registration and verification of IPI accreditation (agencies)
The Professional registers with accurate and up-to-date information. Every real estate agency declares and provides proof of its accreditation with the Institut professionnel des agents immobiliers (IPI). We may make the activation or maintenance of an agency account subject to verification of this accreditation and suspend any account whose accreditation cannot be confirmed.
6. Financial terms
Access to certain features is subject to a subscription. Payments are processed by our service provider Stripe. The amounts, frequencies and payment methods are indicated during subscription. In the event of late payment by a Professional, late payment interest is due in accordance with Belgian law applicable to transactions between businesses.
7. Obligations of the Professional
- Publish accurate, complete listings that comply with applicable regulations, including mandatory information and indication of the energy performance certificate (PEB) when required by regional regulations.
- Strictly comply with anti-discrimination legislation (see article 8).
- Use applicant information only for the purposes of the rental or sale concerned, excluding any commercial misuse, unsolicited prospecting or resale.
- Request from the applicant only the information authorized by the applicable regional rental regulations (see article 10).
8. Tecto Score and non-discrimination
The Tecto Score is a decision-support tool. It does not constitute a decision and cannot by itself justify the rejection of an application. The Professional undertakes to examine each file as a whole and to justify any refusal in an objective and non-discriminatory manner.
The Professional complies with applicable anti-discrimination legislation and refrains from any distinction based on a criterion protected by such legislation. A legal warning recalling these principles is displayed each time a Tecto Score is consulted.
9. Automated decision-making and human intervention
In accordance with Article 22 of the General Data Protection Regulation (GDPR), the applicant has the right not to be subject to a decision based solely on automated processing that produces legal effects or significantly affects them. The Professional guarantees effective human intervention, the possibility for the applicant to express their point of view and to contest the decision. Since the Tecto Score is a decision-support tool and not a decision, the Professional cannot use it as an exclusive criterion.
10. Exhaustive list of information that may be required
The Professional may only require from an applicant the information and documents authorized by the applicable regional rental regulations (Brussels-Capital Region, Walloon Region or Flemish Region). The Tecto Dossier is only used to transmit what the tenant voluntarily chooses to share. The Professional refrains from requiring any document exceeding the regional legal framework.
11. Hosting of content (DSA Regulation)
The Platform provides a hosting service within the meaning of Regulation (EU) 2022/2065 (DSA). As such, we provide a point of contact, a mechanism for reporting illegal content and justification of moderation decisions. The obligations specific to very large platforms do not apply to the Company.
12. Intellectual property
The Company grants the Professional a strictly personal, non-exclusive and non-transferable licence to use the Platform, limited to the duration of the contract. For the content that the Professional publishes (listings, texts, images), they grant the Company a licence limited to hosting, technical reproduction and representation, solely for the purposes of providing the service and for the duration of the contract. No worldwide, perpetual or transferable licence to third parties is granted.
13. Liability
The Company is subject to an obligation of means. It is not responsible for decisions made by the Professional, particularly on the basis of a Tecto Score, nor for the accuracy of information provided by applicants. To the extent permitted by Belgian law, the Company's liability is capped at the amount paid by the Professional during the twelve months preceding the event giving rise to liability.
14. Duration, termination, applicable law
The contract is concluded for the duration of the subscription and is renewed according to the terms indicated during subscription. Each party may terminate it under the conditions provided. These terms and conditions are governed by Belgian law. Any dispute falls under the jurisdiction of the courts of Brussels, without prejudice to the applicable mandatory rules.
