1. Purpose and parties

These terms and conditions of sale govern the subscription to the paid plans of the IMMOTECTO platform between IMMOTECTO SRL, CBE 1037.432.024, VAT BE1037.432.024, with registered office at Rue de Namur 13D, 1476 Houtain-Le-Val, Belgium (the "Company"), and any person subscribing to a paid plan (the "Customer"). They supplement the applicable terms of use.

2. Paid plans and services

Depending on the chosen plan, paid plans give access to listing publication, TectoPass verification, the Tecto Directory and messaging. The features included in each plan are displayed at the time of subscription.

3. Plans and prices

Prices are shown in euros at the time of subscription. For professional Customers they are exclusive of VAT, the applicable VAT being added at invoicing. For consumer Customers they are inclusive of all taxes.

3.1 Landlord plans

  • Essential: 59.99 € one-time payment (1 listing, 20 photos, 2 months of display, 3 TectoPass verifications).
  • Gestion: 34.99 €/month or 349.90 €/year (5 simultaneous listings, access to the Tecto Directory, 20 TectoPass verifications per month).

3.2 Agency plans

  • Access: 99 €/month or 990 €/year (TectoPass verification, without listing publication).
  • Starter: 399 €/month or 3,990 €/year (50 simultaneous listings, 250 TectoPass verifications per month).
  • Premium: 699 €/month or 6,990 €/year (200 simultaneous listings, access to the Tecto Directory, 500 TectoPass verifications per month).

Annual plans are paid in advance for twelve months and include two months free compared with the monthly rate.

4. Monthly Gestion plan: initial three-month commitment

The Gestion plan subscribed on a monthly basis includes an initial three-month commitment. At subscription, the first three months, i.e. 104.97 €, are charged at once. No monthly charge occurs during this initial three-month period already paid. After this period, the subscription continues at 34.99 € per month, charged monthly, and remains terminable under article 6. These terms are reminded to the Customer before the order is confirmed.

5. Payment

Payments are processed by our provider Stripe. Accepted means are bank card (Visa, Mastercard) and Bancontact, as well as direct debit for subscriptions. An invoice is issued for each payment and remains available from the Customer area. In the event of late payment by a professional Customer, late-payment interest and a fixed recovery indemnity are due in accordance with Belgian law applicable to business-to-business transactions.

6. Term, renewal and termination

Subscriptions are taken out for the chosen term (monthly or annual) and renew automatically for an identical period unless terminated. The Customer may terminate from their personal area at any time; termination takes effect at the end of the current period already paid, without refund of that period. For the monthly Gestion plan, termination cannot take effect before the end of the initial three-month commitment already paid. The Company may terminate in the event of breach of the terms of use, non-payment after a formal notice left without effect, or fraudulent use.

7. Right of withdrawal

The consumer Customer has a period of fourteen days from the conclusion of the contract to withdraw without reason or penalty, in accordance with article VI.47 of the Belgian Code of Economic Law. To exercise it, they notify their decision by email to contact@immotecto.com.

In accordance with article VI.53 of the same code, where the consumer Customer expressly requests the immediate performance of a digital service and acknowledges losing the right of withdrawal once the service is fully performed, that right can no longer be exercised after full performance. As long as the service is not fully performed, a Customer who withdraws owes the amount corresponding to the service already provided. A professional Customer acting in the course of their business does not benefit from the consumer right of withdrawal.

8. Price changes

The Company may change its prices. New prices apply to new subscriptions and renewals; they do not change the price of a period already paid. Any price change applicable to an ongoing subscription is notified to the Customer before it takes effect, the Customer then being able to terminate before renewal.

9. Liability

The Company has a best-efforts obligation. To the extent permitted by Belgian law, its liability is capped at the amounts paid by the Customer during the twelve months preceding the triggering event. The Company is not liable in the event of force majeure.

10. Personal data

The processing of personal data is governed by the privacy policy available on the Platform. The Customer has the rights provided by the General Data Protection Regulation.

11. Mediation

In the event of a dispute, the consumer Customer may use the Consumer Mediation Service free of charge (FPS Economy, Belgium).

12. Governing law and jurisdiction

These terms are governed by Belgian law. Any dispute falls within the jurisdiction of the courts of Brussels, without prejudice to mandatory rules protecting the consumer.
