The main residence lease in Brussels is governed by the Brussels Housing Code, a regional legislation specific to the Brussels-Capital Region, distinct from the rules applied in Wallonia and Flanders. What are the possible lease durations in Brussels?
Brussels law recognizes three main types of main residence leases:
1. The 9-year lease (the default duration)
The standard duration for a main residence lease is nine years. This lease, often called "3-6-9", applies automatically when no duration is specified in the contract. It is structured in three three-year periods, each opening specific rights for the landlord.
- The tenant may terminate at any time, subject to 3 months' notice, regardless of the year of the lease. No compensation is due if they leave after the third year.
- The landlord may only terminate during the lease for specific reasons (personal occupation, major works), at the end of a three-year period only, with 6 months' notice and, where applicable, compensation paid to the tenant.
- At the end of the 9 years, either party must give at least 6 months' notice to terminate the lease. Without valid notice, the lease automatically extends for 3 years.
2. The short-term lease (maximum 3 years)
The short-term lease is concluded for a period equal to or less than 3 years. Since 1 November 2024, its renewal is limited to once only: beyond that, it automatically converts into a 9-year lease if no notice is given at expiry.
New since November 2024: the landlord can no longer increase the rent (beyond statutory indexation) between two successive short-term leases for a total period of 9 years. Any new short-term lease must also state the rent of the previous tenant, on pain of an administrative fine of up to €200.
Since 1 November 2024, a Brussels tenant on a short-term lease can also send a counter-notice of 1 month if their landlord notifies them of 3 months' notice, allowing them to leave earlier without compensation.
3. The shared residence lease (flatshare)
The shared residence lease, mainly used for flatshares, is a specific form recognized by Brussels legislation. Each flatmate can join individually, and a flatshare agreement specifies internal rights and obligations. Duration and notice rules generally follow those of the 9-year or short-term lease depending on the chosen formula, with special provisions for a flatmate leaving the contract.

What is the maximum rental deposit in Brussels?
Since the April 2024 reform (effective 1 November 2024), the rental deposit is capped at 2 months' rent in the Brussels Region (and in Wallonia). By comparison, Flanders allows up to 3 months.
The deposit is not legally mandatory, but the vast majority of landlords require it. It is generally paid into a blocked bank account in the tenant's name.
Since November 2024, the landlord has a maximum of 2 months after the end of the lease to release the deposit. In case of unjustified delay, they are liable to a penalty of 10% of the monthly rent per month of delay.
What are the notice periods according to the type of lease?
Notice periods differ depending on the lease duration and who initiates the termination:
9-year lease, tenant side:
- 3 months' notice at any time, from the first day of the month following dispatch.
- Compensation due only during the first 3 years (equivalent to 3, 2 or 1 months' rent depending on the year of departure).
9-year lease, landlord side:
- Termination at expiry: 6 months' notice, no reason required.
- Termination during the lease for personal occupation: 6 months' notice, at any time.
- Termination for major works: only at the end of a three-year period, 6 months' notice.
Short-term lease, tenant side:
- 3 months' notice before expiry.
- Possibility of sending a 1-month counter-notice if the landlord has notified 3 months' notice (new since November 2024).

- Termination during the lease for personal occupation only (from the 2nd year), with 3 months' notice and compensation.
What are the landlord's habitability obligations in Brussels?
The Brussels Housing Code imposes minimum safety, habitability and equipment conditions on all landlords. These standards, reinforced by an order of 30 November 2023 and the ordinance of 4 April 2024, now apply to all housing offered for rent, whether occupied or not.
Among the specific obligations since November 2024:
- The property must meet standards for heating, hot water production and window frames, now included in controllable elements.
- A landlord cannot offer for rent a property that does not meet these standards: the prohibition on letting is formal.
- In case of non-compliance found after signing the lease, the tenant may require the works to be carried out or request termination of the contract with damages.
- If the administrative letting ban was established before signing, the lease is void.
- The Regional Housing Inspection Directorate (DIRL) can inspect any rented property. Since November 2024, any notice given by a landlord is suspended if a complaint for non-compliance is filed.
Since November 2024, it is also prohibited to contractually prohibit the keeping of a pet without just cause.
Lease registration: a regionalized obligation in Brussels since 2025
Registration of the main residence lease is mandatory and free of charge. Since 1 January 2025, a new specifically Brussels procedure applies:
- The lease must now be registered in the electronic register managed by Bruxelles Logement (Regional Lease Registration Service), and no longer via the FPS Finance (MyRent).
- The landlord electronically deposits the lease, its annexes and the entry inventory. Postal deposit or by appointment at the counter remains possible.
- An acknowledgement of receipt is sent simultaneously to the landlord and tenant.
- Registration confers certain date to the lease: no one can contest its existence or date.
- If the lease is not registered, the tenant may leave the property without notice or compensation.
What are the fundamental rights of the Brussels tenant?
Brussels law grants tenants enhanced protection:
- Right to compliant housing: the tenant may require the property to comply with Brussels Housing Code standards at any time during the lease.
- Right to leave freely: the tenant on a 9-year lease may terminate at any time with 3 months' notice. After the third year, no compensation is due.
- Protection in case of sale: lease registration protects the tenant against abrupt termination in case of sale of the property.
- Rent transparency: since November 2024, any new short-term lease must state the rent of the previous tenant.
- Rent freeze: in a succession of short-term leases, rent cannot be increased beyond statutory indexation for 9 years.
- Prompt release of deposit: the landlord has 2 months after the end of the lease to return the deposit, on pain of penalty.
